Jessica Withmann and Jasmine Landau of Reconstruct share important takeaways from a recent decision in which a debtor’s attempts to restructure under the CCAA were rejected in favour of a receivership, warning that, among other things, debtors should potentially avoid executing a forbearance agreement at all as they cannot be certain that the agreement will not be used to deny CCAA relief if their out-of-court restructuring efforts should fail, or if time should run out.
