WEPP relief available in RVO context, Commercial List finds for the first time in Ontario

Adam Slavens, Mike Noel and Charles Kanani of Torys reveal that Ontario’s Commercial List has confirmed for the first time that terminated employees may access WEPP payments after a CCAA reverse vesting order transaction where employment liabilities are transferred to a bankrupt ResidualCo, giving insolvency practitioners greater certainty that RVOs do not necessarily cut off employee wage-protection relief.
