Statement by the Superintendent of Bankruptcy on the Supreme Court of Canada decision in Poonian v. BCSC

The OSB has published a statement clarifying its position in the wake of the Supreme Court of Canada’s decision in Poonian, disagreeing with the notion that the decision provides fraudsters a way to escape paying fines and penalties, instead arguing that the decision accurately describes the balancing of interests that is a necessary element of insolvency legislation.
