Rosen Goldberg appointed receiver for Ajax mixed-use site

Justice F.L. Myers of the Ontario Superior Court (Commercial List) appointed Rosen Goldberg Inc. as receiver and manager of the assets of 27 Harwood Avenue Inc. on October 10 2025, following an application by Sky Mortgage Corporation under section 243(1) of the Bankruptcy and Insolvency Act. The receivership covers the lands municipally known as 27, 29, and 31 Harwood Avenue South in Ajax, a 0.73-acre parcel proposed for a ten-storey mixed-use redevelopment.
Sky Mortgage is owed roughly $2.56 million under two loans secured by first and second charges on the property, in default since June 2025. The lender’s bid for a court-appointed receiver followed months of failed sale efforts after the listing broker terminated its engagement amid competing claims by TriDelta Investment Counsel-affiliated general partners and the debtor’s director Mohammad Tajbakhsh, who are already entangled in multiple Commercial List disputes.
The Court empowered Rosen Goldberg Inc. to take possession of the property, manage and market it, and conduct a sale process subject to court approval. The issue of whether the receivership should extend beyond the real property to the entire estate of 27 Harwood Avenue Inc. was adjourned for future determination.
