Court of Appeal for Ontario issues guidance on appeals from bankruptcy orders and Mareva survival

Scott Bomhof, Jeremy Opolsky, Alex Bogach and Charles Kanani of Torys summarize a recent the Ontario Court of Appeal decision confirming that bankruptcy orders involving more than $10,000 in property are appealable as of right, that CCAA monitors authorized to litigate may take incidental enforcement steps as judgment creditors, and that Mareva injunctions can be preserved through bankruptcy where the stay is effectively lifted under section 69.4 of the BIA.
